Terms of service

These terms are an agreement between you and HECANO LLC ("we") for using Virtucano at https://virtucano.com. If you use Virtucano for a business, you accept them for that business too, and confirm you may. If you don't agree, please don't use Virtucano.

What Virtucano does

Virtucano reports what AI assistants and search engines say about a business, keeps a record of the business's facts (the Truth Ledger), proposes changes, ships the ones you approve or your autonomy settings allow through services you connect, and measures what they did. The free report needs no account; everything else does.

Your account

Anyone who can read your email can sign in to your account, so keep your email secure. You're responsible for what's done with your account, including through API keys and agents you connect.

Businesses and connections

Only add or claim a business you own or are authorized to manage, and only connect accounts and websites you're allowed to. You authorize Virtucano to read what you connect and to make the changes you approve, or that your autonomy settings allow, on your behalf. It posts review replies and updates your Google Business Profile without asking only if you've turned that on for each. You can undo a change, change your settings or disconnect at any time.

Your content

You keep ownership of what you put into Virtucano, and of your business's data. You let us use it to run Virtucano for you, including sending it to the services our privacy policy describes. You're responsible for your Truth Ledger being accurate and for the content you approve. Virtucano checks every change against quality gates, but the decision to publish is yours.

Reports, estimates and results

Virtucano reports what assistants said when it asked them. Their answers vary, change and can be wrong. Virtucano's numbers are estimates with stated ranges, not guarantees, and we don't promise any ranking, recommendation, traffic, lead or revenue result.

Free reports

Anyone can run a free report on any business, including a competitor's. A report shows what AI assistants said; don't present it as a statement by the business or by us.

Acceptable use

Don't use Virtucano to:

• publish false or misleading information, or harass anyone;
• claim a business you don't represent;
• get around its limits or security, such as rate limits, spend caps or the bot check, or interfere with how it runs;
• scrape it, or resell it without our written agreement;
• break the law, or the terms of the services Virtucano connects to.

Text messages

Virtucano weekly briefing. If you add a mobile number and turn on text briefings, Virtucano texts you a weekly summary of your business, including changes waiting for your approval, which you can approve or skip by replying. Expect about one message a week, plus replies to your texts. Message and data rates may apply. Reply STOP to cancel; you'll get a confirmation and no further texts. Reply START to resume, or HELP for help; you can also write to [email protected]. Carriers aren't liable for delayed or undelivered messages. Agreeing to texts isn't a condition of any purchase. Our privacy policy explains how we handle your number.

Reviews and review requests

Virtucano drafts replies to your Google reviews, with AI; a reply goes up only when you approve it, or after you've turned on posting replies without asking, and you can take it down in one step. Send review requests only to customers who expect to hear from you, and ask every customer the same way: don't use Virtucano to ask only the customers you think are happy, or to offer anything in exchange for a review, which Google's policies forbid. You're responsible for having the right to contact the people you add.

Plans, trials and billing

Virtucano has a Free plan and paid plans, described with their prices on the pricing page. Prices are in US dollars. Nothing starts costing money without your agreement.

Trial. Claiming a business starts a free 14-day trial of Essentials for your account, once per account, with no card needed. To keep Essentials after the trial, subscribe before it ends. If you do with more than two days of the trial left, the first charge is on the trial's last day; otherwise it's when you subscribe. If the trial ends without a subscription, your account moves to Free.

Design partners. Accounts that claimed a business while we offered Essentials free in early access are design partners: Essentials stays free for them, and we'll ask before that changes. Early access has a limited number of places. Once they're taken, accounts that claim a business join a waitlist and use Free; they become design partners only if we offer them a place.

Subscriptions. Paid plans are monthly subscriptions, paid in advance through our payment processor, Stripe, and they renew each month until cancelled. By subscribing, you authorize us, through Stripe, to charge your payment method each month. You can update your card and see your invoices in the billing portal, linked from your plan in Virtucano.

Locations. Essentials costs $39 a month per location, and each business in your account is one location. The trial covers every business in your account, and when you subscribe, you pay for each business in your account at that time. While you're subscribed, only your account's owners and admins can add a business, and we show them the new monthly price before they do. Adding one raises your price: Stripe charges the difference for the rest of the current month on your next invoice, and the new price after that. Owners and admins can also remove a business, from its settings, which deletes it at once. If a business is removed while you're subscribed, by you or by us at your request, your price goes down, and the unused part of the month for that business is credited toward your next invoice. A subscription always pays for at least one location, so to stop paying for your last one, cancel your subscription.

Cancelling. You can cancel anytime in the billing portal. Cancelling takes effect at the end of the month you've paid for: until then you keep your plan, and then your account moves to Free.

Refunds. Payments aren't refundable, and we don't refund partial months, except where the law requires it. A credit for a location removed partway through a month goes toward your next invoices; it isn't paid out.

Failed payments. If a payment fails, Stripe tries again over the following days. If it still can't be collected, the subscription ends and your account moves to Free.

On Free. You keep your reports, Truth Ledger, connections, history and the changes already live, and get a monthly briefing. Weekly tracking and the weekly briefing stop, and Virtucano stops shipping changes until you subscribe. Moving to Free never deletes your data.

Price changes. We may change our prices. We'll email you at least 30 days before a new price applies to your subscription, and you can cancel before it does.

Ending

You can stop using Virtucano at any time, and ask us to delete your account; cancel any subscription in the billing portal too, or it renews. We may suspend or end your access if you break these terms, or to protect Virtucano or others; when we can, we'll tell you first.

Disclaimers

Virtucano is provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't control the AI assistants, search engines or other services Virtucano works with, and aren't responsible for what they do.

Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about Virtucano is limited to the greater of what you paid us in the 12 months before the claim and $100.

Indemnity

If you use Virtucano for a business, you'll defend and compensate us for third-party claims arising from content you approved or from your breach of these terms.

Changes to these terms

We may update these terms. We'll post the new version here with a new date, and email account holders about significant changes before they take effect. If you keep using Virtucano after that, the new terms apply.

General

These terms are governed by the laws of the place where HECANO LLC is established, without regard to its conflict-of-law rules. If part of these terms can't be enforced, the rest still applies. These terms and the privacy policy are the whole agreement between you and us about Virtucano.
